General Terms and Conditions (GTC) – "Ferienwohnungen Sand und Stein"

Hosts:

1. Arrival / Departure
The apartment is available for occupancy from 3:00 PM on the day of arrival. Key handover takes place by prior arrangement.
Upon departure, the apartment must be handed over to the hosts or their authorized representative in proper condition. Departure must take place by 10:00 AM.

Should the guest fail to arrive by 10:00 PM on the day of arrival, the contract shall be deemed terminated after a period of 48 hours if no notification has been provided to the hosts. The hosts may then freely dispose of the property.

As a general rule, no (partial) refund of the rental fee will be provided in the event of early departure.

2. Special Requests and Ancillary Agreements
These are generally possible but require written confirmation from the host.
If pets are brought along, their species and size must be specified.

3. Payment
The rental agreement becomes valid upon receipt of the down payment in the host's account. The down payment, amounting to 20% of the total rental fee, is due within seven days of receipt of the booking documents. Once the down payment has been made, the payment of the remaining balance becomes due 30 days prior to the start of the stay. If these payment deadlines are not met, the host reserves the right to withdraw from the contract. Non-payment shall be deemed a cancellation and entitles the host to re-rent the property.

No additional charges are levied for water, energy, parking, waste disposal, or Wi-Fi usage.
If pets are brought along, a flat-rate fee for final cleaning applies.

4. Cancellation
The guest may withdraw from the contract at any time.
Cancellation must be submitted in writing. In the event of cancellation, the following cancellation fees apply:

Cancellation received no later than:
up to 30 days prior to arrival --- €20
up to 14 days prior to arrival --- Amount of the deposit
up to 7 days prior to arrival --- 50% of the accommodation price
up to 3 days prior to arrival --- 80% of the accommodation price

The decisive date is the date on which the cancellation notice is received. Any amounts already paid will be credited against these fees.

You may designate a substitute person to assume the contract under the aforementioned terms. Written notification is sufficient.

5. Guest Obligations
The guest is obliged to treat the vacation apartment, as well as its furniture and furnishings, with care.
The guest is liable for and must compensate for any damages caused by them. In the event of breakage or loss, current replacement costs will be used as the basis for compensation.

These are non-smoking apartments. This means that smoking is strictly prohibited within the rooms of the vacation apartments. In the event of a violation, a flat-rate cleaning fee of €300 will be charged.

The guest is obliged to use water, energy, and heating resources responsibly and economically.

Any defects or deficiencies must be reported to the host immediately.

In the event of lost keys, the lock cylinders will be replaced for security reasons. The guest is responsible for bearing the resulting costs.

Upon departure, household waste must be disposed of in the designated bins, and dishes must be washed, cleaned, and stored in the kitchen cupboards.

6. Electric Vehicles
A wallbox is available at the vacation apartments. A fee based on actual consumption applies for its use.
An RFID card is required to use the wallbox. Upon the tenant's request, we will issue this card on the day of arrival in exchange for an advance payment of €100. At the end of the rental period, this advance payment will be offset against the actual consumption.

Charging electric vehicles via the standard electrical outlets within the vacation apartment is strictly prohibited.

7. Data Protection
The guest consents to the storage, modification, and/or deletion of personal data necessary for the fulfillment of the contract concluded with them. All personal data will be treated with absolute confidentiality.

8. Liability
The property listing has been prepared to the best of our knowledge. No liability is accepted for any impact on the rental property caused by force majeure, customary local power or water outages, or severe weather conditions. Likewise, no liability is accepted in the event of unforeseeable or unavoidable circumstances—such as official directives, sudden construction work, or disruptions arising from natural or local conditions. However, the host will be happy to assist in resolving such issues (insofar as this is possible).
The host accepts no liability for the use of any provided recreational or sports equipment.
The guest is solely responsible and liable for their own arrival at and departure from the property. The host accepts no liability for the theft of or damage by fire to the guest's personal belongings. The guest is fully liable for any willful destruction of or damage to the property.

9. Final Provisions
The photos and text featured on the website or in the brochure are intended to provide a realistic description of the property. However, a 100% exact match with the actual rental property cannot be guaranteed. The host reserves the right to make changes to the furnishings and amenities (e.g., furniture), provided that the replacements are of equivalent value.
Should one or more provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely reflects the economic and legal intent of the contracting parties.
German law shall apply. The place of jurisdiction and place of performance shall be the host's place of residence.
